data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t\t<p><strong>Markabati Car Loan T&amp;C<\/strong><\/p><h5 data-start=\"109\" data-end=\"138\"><strong data-start=\"112\" data-end=\"138\">Borrower\u2019s Obligations<\/strong><\/h5><p data-start=\"140\" data-end=\"178\">The Borrower undertakes and covenants:<\/p><ul data-start=\"180\" data-end=\"1787\"><li data-start=\"180\" data-end=\"514\"><p data-start=\"182\" data-end=\"207\"><strong data-start=\"182\" data-end=\"207\">Repayment Obligations<\/strong><\/p><ul data-start=\"210\" data-end=\"514\"><li data-start=\"210\" data-end=\"322\"><p data-start=\"212\" data-end=\"322\">To repay the Loan, Interest, and all costs, fees and expenses to the Bank within the Term on their due date.<\/p><\/li><li data-start=\"325\" data-end=\"514\"><p data-start=\"327\" data-end=\"514\">If the due date for an Installment or any other payment falls on a Friday, Saturday, or public holiday in Oman, such payment shall be deemed due on the immediately preceding business day.<\/p><\/li><\/ul><\/li><li data-start=\"516\" data-end=\"1016\"><p data-start=\"518\" data-end=\"568\"><strong data-start=\"518\" data-end=\"568\">Maintaining Funds &amp; Direct Debit Authorization<\/strong><\/p><ul data-start=\"571\" data-end=\"1016\"><li data-start=\"571\" data-end=\"708\"><p data-start=\"573\" data-end=\"708\">To always maintain in the Borrower\u2019s account (\u201cAccount\u201d) sufficient funds equivalent to the agreed monthly Instalments plus Interest.<\/p><\/li><li data-start=\"711\" data-end=\"1016\"><p data-start=\"713\" data-end=\"783\">The Borrower irrevocably authorizes the Bank to debit the Account for:<\/p><ul data-start=\"788\" data-end=\"1016\"><li data-start=\"788\" data-end=\"807\"><p data-start=\"790\" data-end=\"807\">Loan repayments<\/p><\/li><li data-start=\"812\" data-end=\"827\"><p data-start=\"814\" data-end=\"827\">Instalments<\/p><\/li><li data-start=\"832\" data-end=\"844\"><p data-start=\"834\" data-end=\"844\">Interest<\/p><\/li><li data-start=\"849\" data-end=\"950\"><p data-start=\"851\" data-end=\"950\">Costs and Fees (processing fees, documentation fees, vehicle registration fees, legal fees, etc.)<\/p><\/li><li data-start=\"955\" data-end=\"1016\"><p data-start=\"957\" data-end=\"1016\">Any amended Interest, Costs or Fees as notified by the Bank<\/p><\/li><\/ul><\/li><\/ul><\/li><li data-start=\"1018\" data-end=\"1211\"><p data-start=\"1020\" data-end=\"1056\"><strong data-start=\"1020\" data-end=\"1056\">Vehicle Valuation &amp; Preservation<\/strong><\/p><ul data-start=\"1059\" data-end=\"1211\"><li data-start=\"1059\" data-end=\"1139\"><p data-start=\"1061\" data-end=\"1139\">To have the Vehicle valued by a Bank-approved valuer at the Borrower\u2019s cost.<\/p><\/li><li data-start=\"1142\" data-end=\"1211\"><p data-start=\"1144\" data-end=\"1211\">To not perform or omit any act that diminishes the Vehicle\u2019s value.<\/p><\/li><\/ul><\/li><li data-start=\"1213\" data-end=\"1421\"><p data-start=\"1215\" data-end=\"1243\"><strong data-start=\"1215\" data-end=\"1243\">Verification by the Bank<\/strong><\/p><ul data-start=\"1246\" data-end=\"1421\"><li data-start=\"1246\" data-end=\"1421\"><p data-start=\"1248\" data-end=\"1421\">To consent to the Bank contacting or visiting the Borrower\u2019s office\/residence or using any method for verification or re-verification of the Borrower\u2019s provided information.<\/p><\/li><\/ul><\/li><li data-start=\"1423\" data-end=\"1563\"><p data-start=\"1425\" data-end=\"1463\"><strong data-start=\"1425\" data-end=\"1463\">Restriction on Disposal of Vehicle<\/strong><\/p><ul data-start=\"1466\" data-end=\"1563\"><li data-start=\"1466\" data-end=\"1563\"><p data-start=\"1468\" data-end=\"1563\">To not sell, mortgage, or lease the Vehicle during the Term without the Bank\u2019s written consent.<\/p><\/li><\/ul><\/li><li data-start=\"1565\" data-end=\"1787\"><p data-start=\"1567\" data-end=\"1600\"><strong data-start=\"1567\" data-end=\"1600\">Leaving the Sultanate of Oman<\/strong><\/p><ul data-start=\"1603\" data-end=\"1787\"><li data-start=\"1603\" data-end=\"1787\"><p data-start=\"1605\" data-end=\"1648\">If intending to leave Oman permanently, to:<\/p><ul data-start=\"1653\" data-end=\"1787\"><li data-start=\"1653\" data-end=\"1702\"><p data-start=\"1655\" data-end=\"1702\">Inform the Bank at least one month in advance<\/p><\/li><li data-start=\"1707\" data-end=\"1787\"><p data-start=\"1709\" data-end=\"1787\">Repay the remaining Loan balance, Interest and Costs and Fees before departure<\/p><\/li><\/ul><\/li><\/ul><\/li><\/ul><hr data-start=\"1789\" data-end=\"1792\" \/><h5 data-start=\"1794\" data-end=\"1809\"><strong data-start=\"1797\" data-end=\"1809\">Security<\/strong><\/h5><p data-start=\"1811\" data-end=\"1864\">In consideration of the Loan, the Borrower agrees to:<\/p><ul data-start=\"1866\" data-end=\"2842\"><li data-start=\"1866\" data-end=\"2007\"><p data-start=\"1868\" data-end=\"1889\"><strong data-start=\"1868\" data-end=\"1889\">Salary Assignment<\/strong><\/p><ul data-start=\"1892\" data-end=\"2007\"><li data-start=\"1892\" data-end=\"2007\"><p data-start=\"1894\" data-end=\"2007\">Assign salary, pension, and\/or end-of-service benefits to the Account to cover Loan, Interest and Costs and Fees.<\/p><\/li><\/ul><\/li><li data-start=\"2009\" data-end=\"2401\"><p data-start=\"2011\" data-end=\"2043\"><strong data-start=\"2011\" data-end=\"2043\">Mortgage\/Charge Over Vehicle<\/strong><\/p><ul data-start=\"2046\" data-end=\"2401\"><li data-start=\"2046\" data-end=\"2180\"><p data-start=\"2048\" data-end=\"2180\">Register a mortgage\/charge over the Vehicle with the Royal Oman Police in favour of the Bank for the full Term and any extensions.<\/p><\/li><li data-start=\"2183\" data-end=\"2319\"><p data-start=\"2185\" data-end=\"2319\">Authorize the Bank to take possession of the Vehicle (with or without court proceedings) and sell it to recover outstanding amounts.<\/p><\/li><li data-start=\"2322\" data-end=\"2401\"><p data-start=\"2324\" data-end=\"2401\">Bear responsibility for all taxes, fees, fines, maintenance, and other costs.<\/p><\/li><\/ul><\/li><li data-start=\"2403\" data-end=\"2719\"><p data-start=\"2405\" data-end=\"2447\"><strong data-start=\"2405\" data-end=\"2447\">Lien Over the Account &amp; Set-off Rights<\/strong><\/p><ul data-start=\"2450\" data-end=\"2719\"><li data-start=\"2450\" data-end=\"2507\"><p data-start=\"2452\" data-end=\"2507\">Create a lien over the Account in favour of the Bank.<\/p><\/li><li data-start=\"2510\" data-end=\"2657\"><p data-start=\"2512\" data-end=\"2657\">Agree that all accounts of the Borrower (local or international, including foreign currency accounts) constitute a <strong data-start=\"2627\" data-end=\"2654\">single combined account<\/strong>.<\/p><\/li><li data-start=\"2660\" data-end=\"2719\"><p data-start=\"2662\" data-end=\"2719\">Allow the Bank full right of set-off across all accounts.<\/p><\/li><\/ul><\/li><li data-start=\"2721\" data-end=\"2842\"><p data-start=\"2723\" data-end=\"2746\"><strong data-start=\"2723\" data-end=\"2746\">Additional Security<\/strong><\/p><ul data-start=\"2749\" data-end=\"2842\"><li data-start=\"2749\" data-end=\"2842\"><p data-start=\"2751\" data-end=\"2842\">Provide additional securities (promissory notes, guarantees, etc.) if required by the Bank.<\/p><\/li><\/ul><\/li><\/ul><hr data-start=\"2844\" data-end=\"2847\" \/><h5 data-start=\"2849\" data-end=\"2871\"><strong data-start=\"2852\" data-end=\"2871\">Representations<\/strong><\/h5><p data-start=\"2873\" data-end=\"2915\">The Borrower represents and warrants that:<\/p><ul data-start=\"2917\" data-end=\"3211\"><li data-start=\"2917\" data-end=\"3023\"><p data-start=\"2919\" data-end=\"3023\">All existing financial liabilities and commitments (other than the Loan) have been disclosed in writing.<\/p><\/li><li data-start=\"3024\" data-end=\"3105\"><p data-start=\"3026\" data-end=\"3105\">All information furnished to the Bank is accurate, complete and not misleading.<\/p><\/li><li data-start=\"3106\" data-end=\"3211\"><p data-start=\"3108\" data-end=\"3211\">No material facts have been omitted or concealed that could adversely affect ability to repay the Loan.<\/p><\/li><\/ul><hr data-start=\"3213\" data-end=\"3216\" \/><h5 data-start=\"3218\" data-end=\"3242\"><strong data-start=\"3221\" data-end=\"3242\">Events of Default<\/strong><\/h5><p data-start=\"3244\" data-end=\"3375\">The Bank may demand immediate repayment of all outstanding Loan amounts, Interest and Costs and Fees if any of the following occur:<\/p><ul data-start=\"3377\" data-end=\"4043\"><li data-start=\"3377\" data-end=\"3428\"><p data-start=\"3379\" data-end=\"3428\">Failure to repay any monthly Instalment when due.<\/p><\/li><li data-start=\"3429\" data-end=\"3494\"><p data-start=\"3431\" data-end=\"3494\">Borrower loses employment (resignation, dismissal, retirement).<\/p><\/li><li data-start=\"3495\" data-end=\"3570\"><p data-start=\"3497\" data-end=\"3570\">Any security provided lapses or decreases in value below required levels.<\/p><\/li><li data-start=\"3571\" data-end=\"3643\"><p data-start=\"3573\" data-end=\"3643\">Bank is prevented by law from allowing the Loan to remain outstanding.<\/p><\/li><li data-start=\"3644\" data-end=\"3725\"><p data-start=\"3646\" data-end=\"3725\">Any representation or statement by the Borrower proves incorrect or misleading.<\/p><\/li><li data-start=\"3726\" data-end=\"3822\"><p data-start=\"3728\" data-end=\"3822\">Borrower fails to perform or comply with this Agreement or any security\/related documentation.<\/p><\/li><li data-start=\"3823\" data-end=\"3940\"><p data-start=\"3825\" data-end=\"3940\">Circumstances arise which, in the Bank\u2019s opinion, indicate the Borrower may be unable to comply with the Agreement.<\/p><\/li><li data-start=\"3941\" data-end=\"4043\"><p data-start=\"3943\" data-end=\"4043\">Borrower breaches terms of any other credit facility with the Bank or another financial institution.<\/p><\/li><\/ul><p data-start=\"4045\" data-end=\"4062\"><strong data-start=\"4045\" data-end=\"4062\">Consequences:<\/strong><\/p><ul data-start=\"4064\" data-end=\"4336\"><li data-start=\"4064\" data-end=\"4164\"><p data-start=\"4066\" data-end=\"4164\">Borrower must immediately repay the entire outstanding Loan plus accrued Interest, Costs and Fees.<\/p><\/li><li data-start=\"4165\" data-end=\"4226\"><p data-start=\"4167\" data-end=\"4226\">The Bank has the right to repossess and sell the Vehicle.<\/p><\/li><li data-start=\"4227\" data-end=\"4336\"><p data-start=\"4229\" data-end=\"4336\">If sale proceeds are insufficient, the Borrower remains liable for the shortfall plus all related expenses.<\/p><\/li><\/ul><hr data-start=\"4338\" data-end=\"4341\" \/><h5 data-start=\"4343\" data-end=\"4378\"><strong data-start=\"4346\" data-end=\"4378\">Bank\u2019s Records and Statement<\/strong><\/h5><ul data-start=\"4380\" data-end=\"4576\"><li data-start=\"4380\" data-end=\"4576\"><p data-start=\"4382\" data-end=\"4576\">In any legal proceedings, the Bank\u2019s statement of account in respect of the Borrower\u2019s Account shall be final and conclusive evidence of outstanding liability, unless a manifest error is proven.<\/p><\/li><\/ul><hr data-start=\"4578\" data-end=\"4581\" \/><h5 data-start=\"4583\" data-end=\"4599\"><strong data-start=\"4586\" data-end=\"4599\">Insurance<\/strong><\/h5><p data-start=\"4601\" data-end=\"4648\">The Borrower must maintain throughout the Term:<\/p><ul data-start=\"4650\" data-end=\"4833\"><li data-start=\"4650\" data-end=\"4718\"><p data-start=\"4652\" data-end=\"4670\"><strong data-start=\"4652\" data-end=\"4670\">Life Insurance<\/strong><\/p><ul data-start=\"4673\" data-end=\"4718\"><li data-start=\"4673\" data-end=\"4718\"><p data-start=\"4675\" data-end=\"4718\">Life insurance coverage of <strong data-start=\"4702\" data-end=\"4717\">OMR 300,000<\/strong>.<\/p><\/li><\/ul><\/li><li
